Liability Waiver and Release of Claims

This Liability Waiver and Release (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of VELARE Wellness, LLC dba Soulscape Pilates, its owners, instructors, employees, contractors, agents, representatives, successors, and assigns (collectively, “VELARE/Soulscape”).

By signing, Participant agrees as follows:

1. Acknowledgment of Risks
I understand that participation in Pilates, sound baths, meditation, breathwork, Reiki, wellness workshops, and related activities (“Activities”) involves inherent risks, including but not limited to: physical exertion, equipment use, slips or falls, strains, injuries, and in rare cases, serious medical events.

I acknowledge that VELARE/Soulscape cannot guarantee my safety and that my participation is voluntary.

2. Health and Medical Clearance
I represent that I am in good health and have no medical condition that would prevent safe participation in Activities.

I agree to consult with a physician prior to participation if I have any concerns about my health or ability to safely engage in Activities.

I agree to notify VELARE/Soulscape of any relevant medical conditions, injuries, or limitations prior to participating.

3. Assumption of Risk
I voluntarily assume full responsibility for all risks of injury, illness, or harm that may result from participation in Activities, whether foreseeable or not.

4. Release and Waiver
In consideration for being permitted to participate in Activities, I release, waive, and discharge VELARE/Soulscape from any and all liability, claims, demands, actions, or causes of action arising out of or related to my participation, including but not limited to negligence, except in cases of gross negligence or willful misconduct.

5. Indemnification
I agree to indemnify and hold harmless VELARE/Soulscape from any loss, liability, damage, or costs incurred due to my participation in Activities.

6. Use of Likeness
I consent to VELARE/Soulscape’s use of photos, video, or other recordings of me taken during Activities for promotional, marketing, or educational purposes, unless I provide written notice otherwise.

7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California.

8. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
